TERMS AND CONDITIONS FOR DIGICOW DAIRY APP.
The following terms and conditions apply to DigiCow Dairy App (“the service”) and by registering to this
service you will be deemed to have read, understood and accepted the same.
1. Acceptance of Terms and Conditions
By accessing and using the service, you agree to be bound by these terms and conditions. If you do not
agree to these terms and conditions, you may have limited access or use of our products and services.
2. Service
2.1. This product enables the subscriber to keep digital records, access digital records, get
notifications and alerts through the app provided by Digicow Africa Limited.
2.2. The subscriber will also be able to access extension services {expert chats, farmer to farmer chat
and audio trainings with written content}
3. Eligibility
This service is open to all customers engaged in Dairy farming and who have android powered phones
and tablets and have downloaded, installed and registered. Customers can access their records via
computers or laptops, training room, access other farmers and experts through chatrooms.
4. Launch of service
This service will run from date of installation onwards
5. How to Access and Use the service
(a) You must have an android powered phone or tablet and or, computer or laptop.
(b) Download DigiCow Dairy App from the play store, install , register (your mobile number and
create a secure PIN.
(c) You will receive an activation code via SMS.
(d) In case you are busy and would wish for another person to be inputting data on your behalf, you
will be required to register the person(s) and control the amount of information you wish them
to see.
(e) Should require any assistance you can reach us via a phone call/SMS………….., Facebook
page…………., WhatsApp, email: info@digicow.co.ke where technical assistance is needed
Digicow Africa Limited will arrange for our support team to visit you at the farm.
(f) Once installed and registered you access the service by using your phone number as the user’s
name and password you created. You must exercise all due care and diligence in order to ensure
the secrecy and confidentiality of the access passwords at all times.
(g) You shall not use and shall ensure that no other person using access to the services uses the
service to;
(i) resale or redistribution to any other person or entity; or
(ii) For storing, reproducing, transmitting, communicating or receiving any offensive
material;
(iii) For fraud or for any criminal purpose or in a manner that is contrary to any
regulatory or legal requirements; or
(iv) To cause annoyance, inconvenience or needless anxiety to any person; or
(v) Contrary to any instructions that may be communicated to you by Digicow Africa
Limited from time to time.
7. How to upgrade your services
You may upgrade your services by applying; go update the app from play store or reaching our support
center for assistance.
8. Suspension or variation of the services
8.1. Digicow Africa Limited may in its sole discretion suspend or vary the services without
liability to compensate you for any period during which it reasonably suspects or
believes that you are in breach of the terms and conditions of this agreement or any
other terms and conditions referred to herein.
8.2. Such a suspension or variation is necessary to facilitate modifications to, or allow for
maintenance to, or allow for planned maintenance of the network provided that we give
you reasonable notice of such suspension, termination or variation
8.3. Digicow Africa Limited is required or requested to comply with an order or instruction of
or on recommendation from the government, court, regulator or other competent
authority.
9. Termination and in ability to perform
9.1. This Agreement may be terminated if:
(a) We have reasons to believe that the service is being used in an unauthorized or illegal way or for
criminal activities or we have been instructed to cease providing the service by any licensing,
law enforcement or regulatory authority;
(b) You choose to terminate this agreement;
(c) Either party commits any material breach of any of the provisions of this agreement and such
breach is not rectified within thirty (30)days from receipt of a written notice giving particulars of
the breach;
(d) Either part becomes bankrupt, or makes any agreement with creditor to go into liquidation or
become subject to an administration order or a receiver is appointed over its asset;
(e) The service is longer available to you upon expiry of this agreement’
9.2. Consequences of termination
Termination shall not affect any subsisting rights either party may have against the other party at the
time of termination.
10. In ability to perform
The obligation of each party under this agreement shall be suspended during the period to the extent
that such party is prevented or hindered from complying therewith by any cause beyond reasonable
control including but not limited to acts of God, war, civil commotion, industrial dispute, inability to
secure materials, act or omission of carriers or suppliers, destruction of or technical challenges beyond
our control or regulatory or regulatory intervention to intervention. If such delay or failure continues for
at least thirty (30) days then either party may terminate this agreement, upon expiry of the thirty (30)
days, by notice in writing to the other.
11. Application Law
This Agreement shall be interpreted, governed and construed in accordance with the laws of the
Republic of Kenya. Any disputes arising from these terms and conditions or your use of our products and
services will be subject to the exclusive jurisdiction of the courts of Kenya.
12. Extension of Terms
12.1. Digicow Africa Limited reserves the right to amend or vary these terms and conditions
or to withdraw the service at any time. In any of these events, notice will be given via
the company website and will be effective immediately or as at the date referred in such
notifications. Your continued use of our products and services after any such
amendments constitutes your acceptance of the amended terms and conditions.

13. Limitation of Liability
Digicow Africa Limited is not liable for any damages or losses that arise from your use or inability to use
our products and services, including any direct, indirect, incidental, or consequential damages.

Digicow Africa Limited may collect and use data from our products and services to improve our services,
develop new products, and market our products and services to you. We will protect your personal data
in accordance with applicable laws and regulations and our privacy policy.
15. Ownership and Intellectual Property:
Digicow Africa Limited owns all the intellectual property rights, including copyright and trademarks, in its
products and services. You may not use, copy, modify, distribute, or create derivative works based on
our products and services without our prior written consent.
